These Terms & Conditions govern the use of the YSHMN Art website and the purchase or commission of artworks offered through YSHMN Art.
By placing an order, commissioning an artwork, or otherwise entering into a transaction with YSHMN Art, you acknowledge that you have read and accepted these Terms & Conditions.
1. GENERAL INFORMATION
YSHMN Art is an independent art practice offering original artworks and bespoke commissioned pieces.

YSHMN Art is currently operating as an independent artistic practice. International business registration and additional international payment infrastructure are in development.
Nothing on this website represents YSHMN Art as a company incorporated or licensed in a jurisdiction where such registration has not yet been completed.
2. ARTWORKS
All artworks offered by YSHMN Art are original works unless expressly stated otherwise.
Artworks may include:
Ready made original artworks available for purchase.
Bespoke artworks created individually according to the client's requirements.
Artworks created as part of a series or collection.
Because each artwork is handmade, minor variations in texture, surface, color, dimensions, and appearance are inherent characteristics of an original work and are not considered defects.
Colors and textures displayed on digital screens may differ slightly from the physical artwork due to photography, lighting, and individual screen settings.
3. COMMISSIONED ARTWORKS
Commissioned artworks are created individually based on specifications agreed with the client.
These may include dimensions, color palette, visual references, interior requirements, materials, artistic direction, and other relevant details.
Before work begins, the principal specifications, price, estimated production timeline, payment terms, and delivery arrangements will be agreed with the client.
Visual references, moodboards, sketches, or concepts may be provided during the development process where appropriate.
The artist retains creative discretion within the agreed artistic direction. As each artwork is created by hand, an exact reproduction of another artwork or digital reference cannot be guaranteed.
The usual production period for a commissioned artwork is approximately 2 to 3 months, unless otherwise agreed.
4. PRICES
Prices displayed on the website apply to the artworks identified on the relevant page unless otherwise stated.
For commissioned artworks, the final price is calculated individually depending on dimensions, materials, complexity, location, production requirements, and other specifications.
Any shipping, insurance, customs duties, taxes, installation costs, or other additional expenses will be communicated separately where applicable.
5. PAYMENT
Payment terms are agreed individually for each order.
At present, payment may be made in cash where legally permissible and mutually convenient.
Additional payment methods may be offered and agreed individually before an order is confirmed.
For commissioned artworks, the payment method and payment schedule are agreed before production begins.
YSHMN Art does not request or store payment card information directly through this website unless a secure payment service is expressly introduced in the future.
6. ORDER CONFIRMATION
An enquiry submitted through the website does not automatically constitute acceptance of an order.
An order is considered confirmed once the essential details, including the artwork, price, payment arrangements, and where applicable production and delivery conditions, have been agreed between YSHMN Art and the client.
Additional written terms or an individual agreement may be used for commissioned artworks and other bespoke projects.
Where an individual written agreement conflicts with these general Terms & Conditions, the individually agreed terms will prevail to the extent permitted by applicable law.
7. WORLDWIDE SHIPPING
YSHMN Art offers worldwide shipping subject to destination, carrier availability, customs restrictions, and applicable law.
Shipping arrangements are agreed individually with the client.
The courier or logistics provider is selected together with the client based on the destination, artwork dimensions, value, packaging requirements, delivery timeframe, and other relevant factors.
Shipping costs are calculated individually.
All agreed delivery conditions may be confirmed in writing or included in the individual agreement.
Delivery times are estimates and may be affected by customs procedures, carrier delays, weather conditions, public holidays, or other circumstances outside the reasonable control of YSHMN Art.
8. CUSTOMS, DUTIES AND TAXES
International shipments may be subject to customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country.
Unless expressly agreed otherwise, such charges are the responsibility of the recipient.
Clients are responsible for ensuring that an artwork may legally be imported into the destination country.
9. RETURNS AND EXCHANGES
Because original and commissioned artworks are unique and handmade, return and exchange conditions may depend on the type of artwork, the circumstances of the transaction, and applicable consumer protection law.
Commissioned artworks created according to individual specifications are generally not eligible for cancellation, return, or exchange after production has begun, except where required by applicable law or expressly agreed otherwise in writing.
Nothing in these Terms & Conditions limits any mandatory consumer rights that cannot legally be excluded.
10. DAMAGED ARTWORKS
If an artwork arrives visibly damaged, the client should photograph the artwork, external packaging, internal packaging, and shipping label as soon as possible.
YSHMN Art should be contacted at yshmnyshmn@gmail.com within 2 business days of delivery.
Claims will be reviewed individually together with the relevant courier or logistics provider.
Depending on the circumstances and applicable law, an appropriate solution may include restoration, replacement, refund, insurance claim, or another mutually agreed resolution.
11. INTELLECTUAL PROPERTY AND COPYRIGHT
Purchase of an original artwork transfers ownership of the physical artwork only.
All copyright and intellectual property rights in the artwork remain with the artist unless expressly transferred in writing.
The purchaser may not reproduce, manufacture, commercially distribute, license, tokenize, digitally reproduce, or otherwise commercially exploit the artwork without prior written permission from YSHMN Art.
YSHMN Art retains the right to photograph and display images of artworks for portfolio, website, social media, exhibition, editorial, archival, and promotional purposes unless otherwise agreed in writing.
12. WEBSITE CONTENT
All photographs, artworks, graphics, text, branding, design elements, and other original content appearing on yshmn.art are protected by applicable intellectual property laws.
Unauthorized commercial reproduction or use is prohibited.
13. LIMITATION OF LIABILITY
YSHMN Art will take reasonable care in the creation, packaging, and coordination of delivery of artworks.
To the extent permitted by applicable law, YSHMN Art is not responsible for delays or losses caused by circumstances beyond its reasonable control, including customs procedures, carrier disruption, force majeure events, or incorrect information supplied by the client.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
14. CHANGES TO THESE TERMS
These Terms & Conditions may be updated from time to time to reflect changes in services, payment methods, business structure, or applicable legal requirements.
The version published on this website at the time of an order will apply unless otherwise agreed in writing.
15. APPLICABLE LAW
Transactions involving YSHMN Art are subject to the mandatory laws and consumer protection requirements applicable to the particular transaction.
Where necessary, governing law and dispute resolution terms may be specified separately in an individual agreement.
